A cyclist was commuting to work in Wakefield when a driver, who was parked on a double yellow line, threw his door open and knocked the cyclist off his bike. The cyclist sustained serious injury and was admitted to hospital for 5 days. He had a fractured shoulder, four fractured ribs and blood in his lungs.

It took him a long time to recover, and after the accident developed something called ‘complex regional pain syndrome’ in his arm, which forced him to leave his job as a factory worker. At the age of 63 he found himself unemployable.

He approached Liddys Solicitors to act for him in a claim against the car driver’s insurance company. Liddy’s obtained medical reports from an A & E Consultant Surgeon, a shoulder surgeon, a chest physician and a clinical psychologist, who all agreed that the claimant would not be able to work again.

The driver insurers disagreed, and their own medical experts claimed that the claimant should have been able to work again 6 months after the accident. We then arranged for a face to face meeting with the defendant’s legal representatives and conducted in-person negotiations, which resulted in £100,000 been awarded to the claimant.

The Defendants had argued that the Claimant’s case was worth £25,000 at best, but by carefully obtaining the right medical evidence and by negotiating aggressively with the other side we have been able to secure a settlement that is four times more than the insurance company said it was worth’.
