Wakefield Man Awarded £6,300 for Accident at Work

A man was working in a factory in Wakefield when a machine stopped working. To try and unjam the machine and get it running again he had to reach deep inside the mechanism and turn a small cog by hand. When the cog came free it span quickly and trapped his fingers.

To try and unjam the machine and get it running again he had to reach deep inside the mechanism and turn a small cog by hand. When the cog came free it span quickly and trapped his fingers. His index finger was fractured and the nail tore off.

To repair the fracture the hospital had to operate and insert a wire. Because of this he was unable to work for 9 weeks. He did receive sick pay during this time, but was still left over £1,000 out of pocket.

He approached Liddys to claim for the injury. Our first step was to obtain details of the insurance company, then we began to put acclaim against them. The insurers quickly admitted fault for the accident.

Our next step was to consult with an orthopaedic surgeon who provided a detailed medical report which stated the client needed extensive physiotherapy but should be recovered within 12 months. Liddy’s arranged the physiotherapy for him, which gave him a great amount of relief.

Liddys Solicitors claimed compensation for his injuries, lost earnings, care and assistance provided by family members, bus fare and taxi expenses and private physiotherapy costs. The insurance company agreed the majority of his losses, but disputed his loss of earnings, claiming that he had only lost £475 instead of the £1,100 claimed by him. We pointed out the mistake in the insurer’s calculation but when the insurers still refused to accept their mistake, we issued court proceedings.

Upon receiving the notice of court proceedings, the insurance company realised their error and agreed that he had indeed lost almost £1,100 in earnings. His case eventually settled for just over £6,300.
