Liddy’s Speaks Out Against Government Attack on Human Rights

Wakefield and Barnsley-based personal injury and clinical negligence specialist Liddy’s Solicitors has this week hit out at the Government’s seemingly systematic attack on people’s human rights following the announcement of the intention to restrict medical evidence in whiplash claims to reports from a panel of medical ‘experts’.

Lead solicitor Kevin Liddy commented on the announcement: “No doubt this panel of ‘experts’ will be like the doctors used in benefits appeals tribunals; the majority of reports for these have now been successfully appealed, which just demonstrates how poor the original assessments were. In road traffic claims, there is likely to be little or no right of appeal.

“This is just one example of the Government’s attack on the rights of the individual. Another is the Government slashing costs recoverable for pursuing claims so that many cases cannot now be pursued because it is simply uneconomic.

The Government has also downgraded the 1993 Health and Safety Regulations introduced by the EEC to regulate the workplace. A breach of those regulations where injury is caused no longer means that the injured person can claim damages. Some of the health and safety protection which has been taken away from the public, has been in existence since the 1800s.

“This is to say nothing of the Government’s attack on the rights of the individual in respect of legal aid, employment tribunals, judicial reviews and immigration law. This Government, like no other before it, has slashed and burned human rights in favour of big business.”

Liddy’s are now calling for all experienced solicitors to take on difficult claims such as medical negligence, accidents involving very serious injuries, and accidents in the workplace.
