Client CRPS Diagnosis After Ankle Surgery, £140,000 Settlement

We were consulted by a 57 year old lady. She suffered an inversion injury to her right ankle. As symptoms did not settle, she underwent surgery to remove a deformity that had developed and a remodelling of the Achilles tendon. This caused an acute pain reaction which her treating specialists diagnosed as CRPS which she had been at high risk of if she had this operation; she had not been informed of the risk before her surgery. She was left with permanent pain and had to give up her employment as a result. It was alleged that had she been told of the CRPS she would have delayed surgery until she had had treatment for the CRPS, which would have avoided the condition.

Liability was denied, but the Defendant offered £140,000 on 23 May 2024 which was accepted.
