Negligent hospital discharge results in settlement of £3,000

Published: 30th November 2021

We acted for the family of an elderly lady who was discharged from Barnsley hospital to a care home on the coldest night of the year in the middle of the night wearing only her night clothes.

When she arrived at the care home, she was distressed and freezing, which exacerbated her heart condition. The care home had not been told by the hospital that she had a heart condition or how to manage it. Therefore, the care home returned her to hospital and again she was freezing and upset. She died six days later.

Her family pursued damages because the discharge was negligent. It will never be known whether it contributed to her death. The claim was settled for damages of £3000.
